Henry Whitehead is Special Counsel with Kaedian LLP. He represents businesses of all sizes and individuals in civil litigation disputes throughout California. Mr. Whitehead has experience in almost every kind of dispute businesses and their owners face and has particular expertise in contract and employment disputes, securities, fraud, trade secrets and other business torts, and trademark litigation. He also has represented clients in white collar criminal defense matters. At Kaedian, Mr. Whitehead works to leverage his over a decade of experience to help clients navigate through a wide range of disputes, which often involve more than just legal considerations.
Prior to joining Kaedian, Mr. Whitehead practiced as a complex commercial litigator at some of the country’s largest and most well-respected law firms, including as an attorney with Fox Rothschild LLP and Dentons US LLP. Mr. Whitehead has obtained notable results for his clients in state and federal court, and at private arbitrations and mediations, including securing recent dismissals on Anti-SLAPP motions and motions to dismiss, and on summary judgment. He works to evaluate cases thoroughly, represent his clients effectively and, where necessary, litigate disputes assertively and aggressively.
Mr. Whitehead obtained his J.D. from UCLA School of Law. At UCLA, he served as an extern for the Honorable George H. Wu of the Central District of California, and as a research assistant for Evidence Professor, and later Dean, Jennifer Mnookin. Before that, Mr. Whitehead graduated cum laude from Dartmouth College with a double major in history and government. Outside of work, Mr. Whitehead cares deeply about his hometown of Los Angeles and is currently a board member and CFO of the GRYD Foundation, which works with city government to support and provide services to youth in disadvantaged communities throughout the city.
Mr. Whitehead is admitted to practice law in state and federal courts in both New York and California.
REPRESENTATIVE MATTERS
Business Litigation
- Secured $1 million judgment by default in Los Angeles Superior Court on a breach of contract matter, succeeded in upholding judgment on appeal, and helped obtain substantial monetary relief for client. (Wong v. First Picks)
- Represented defendant in securities and breach of contract dispute, winning summary judgment on statute of limitations argument. (Feldman v. Yapstone)
- Counsel for defendant property owner in obtaining summary judgment on premises liability claims.
- Successfully represented fine art broker in partnership dispute, negotiating favorable settlement (Fuchs v. Davis). Separately, represented musicians, designers, craft and visual artists, art brokers, and entrepreneurs in the fine arts field, including in breach of contract, commercial, employment, and intellectual property matters.
- Represented youth softball league in securing complete dismissal of former umpire’s defamation action following successful Anti-SLAPP motion. (Anguiano v. Eastvale)
- Counsel for defendant Fox Television Studios in right of publicity action based on the television series “Burn Notice.” Coordinated transfer and consolidation of multiple actions, and drafted successful motion to dismiss (Terry v. Fox)
- Represented entrepreneur and inventor in judgment enforcement proceedings arising out of litigation relating to business venture. Led successful efforts to oppose motion to add client and unrelated business ventures as judgment debtors. (UniSplendor v. Remington Designs).
Trademark Litigation
Represented defendant in federal trademark litigation over website domain and company name, leading discovery efforts and helping negotiate favorable settlement. (Used Cars for Sale v. Carsforsale.com). In a separate matter, counsel for defendant tire manufacturer in trademark and intellectual property dispute relating to tire treads. (Toyo Tire v. Doublestar Dongfeng). Recently, represented business owner in trademark dispute with competitor over use of the mark “Groomingdales” for mobile dog grooming business.
White Collar Criminal Matters
Represented defendants in criminal appeals stemming from financial crimes, including arguing sufficiency of the evidence and propriety of jury instructions (United States v. Gerrans; United States v. Canada). Previously, part of trial team representing Defendant Willie Gault in securities civil enforcement action, securing favorable jury verdict on key fraud claims (SEC v. HeartTronics).
